01How These Terms Apply

These Colocation Terms apply to every colocation Service in addition to our Terms of Service and other policies. Our datacenter partners' rules also apply, and these Terms follow them.

02What We Offer and Who Can Order

Rack units (1U to 4U). Your server is installed in a shared rack managed by us. We offer 1U, 2U, 3U and 4U spaces; anything larger than 4U needs a quarter rack (10U). Customers with rack units do not get physical access to the rack or the datacenter: you ship your equipment to us, our staff install it, and any later hands-on work is done through remote hands.

Racks (quarter rack of 10U, half rack and full rack). You get your own rack space and may visit it under the rules below. Racks are available only to registered businesses, such as a limited liability company or corporation, that hold the insurance described below.

03Insurance Before Rack Access

Before you or anyone working for you can access a rack or deliver equipment to it, you must give us a certificate of insurance (COI) and proof that the policy is in force. The insurance must include general liability cover of at least $1,000,000 per occurrence and $1,000,000 in aggregate, and must name both Internet Nice LLC and the datacenter operator as additional insured, as the datacenter's policy requires. You must also carry workers' compensation insurance as the law requires and employer's liability insurance of at least $500,000 for each accident and each employee, and property insurance for your own equipment. Keep the insurance in force for as long as the Service runs, and send us the renewed certificate before it expires. We may refuse access, or suspend the Service, while valid insurance is not on file.

04Visiting Your Rack

Visits are for rack customers only. Only people you have registered with us in advance can enter, and they must bring government-issued photo ID and follow the datacenter's security, safety and escort rules. Book visits through a ticket at least one business day in advance. We or the datacenter may refuse entry to anyone who breaks these rules.

05Remote Hands

Remote hands are available during business hours, 9:00 am to 5:00 pm facility local time, Monday to Friday, at $75 per hour. Outside business hours the rate is $150 per hour, subject to staff availability. Every request is charged for at least one hour, then in 30-minute increments. Request remote hands through a ticket with clear instructions. We carry out the work as instructed and are not responsible for the result of instructions that turn out to be wrong.

06Power

Committed power. Each rack plan includes a committed power draw, measured as the total drawn from all power feeds supplied to your space together. The committed draw for your plan is shown on your order.

Going over. If your draw rises above the committed level, we charge an overage fee of $37.45 for each additional 0.1 kW, every month, until you upgrade to a plan that covers your usage.

The rack maximum. Following the electrical code, when your space has A and B circuits, the load on each circuit must stay at or below 40% of its rating, so that if one fails the other carries everything at no more than 80% of its rating. Above that maximum, a higher fee of $49.93 for each additional 0.1 kW applies, and the datacenter may disconnect the power to protect its systems. The limit exists because of the capacity of the datacenter's backup power and cooling, and because if one feed fails your whole load must be carried by the other.

Redundancy. Power redundancy and our power commitment under the Service Level Agreement apply only to equipment with dual power supplies, with one connected to each of our A and B power distribution units. For rack units, we connect your equipment for you. Spread single-supply equipment evenly across the two feeds, and note that it is not protected if one feed fails. Configure equipment to start up with a delay after power returns, so that everything does not power on at once and trip a breaker.

07Your Equipment

Your equipment remains yours and stays at your risk; your insurance must cover it. Label it clearly, keep it in good working order, and install only rack-mountable equipment suitable for a datacenter. Batteries, flammable or hazardous materials, and anything that endangers people or other customers' equipment are not allowed. We are not liable for loss of or damage to your equipment except where caused by our gross negligence or wilful misconduct.

08Deliveries and Cross-Connects

Tell us about deliveries in advance through a ticket, with the courier's tracking details. Bulk deliveries need our approval first so we can arrange them with the datacenter. Cross-connects to other networks in the building are ordered through us at $199 per month plus a $199 setup fee each, and the datacenter installs all cabling between spaces.

To remove equipment that takes up more than 30U, tell us at least 3 days in advance. To remove all of your equipment and move out, tell us at least 5 business days in advance.

09Datacenter Rules

  • Use only standard racks we provide, unless we approve otherwise in writing.
  • Keep floor load within the datacenter's limit of 200 pounds per square foot.
  • Keep your space clean; do not leave boxes, packaging or rubbish overnight.
  • Do not bring food, drinks or other liquids, combustible or hazardous materials, magnetic devices, cameras or other recording equipment, animals, or children under 16.
  • Do not touch or enter other customers' spaces, prop open doors, change locks, adjust shared cooling, or put up signs.
  • All cabling inside shared areas and meet-me rooms is installed by datacenter staff.
  • Follow the datacenter's security procedures and any further rules it publishes. You must pay for any damage you or your visitors cause.

10Contract Term, Price Changes and Early Termination

Term. Racks are sold on a 12-month contract, with a one-time setup fee shown on your order. After the first 12 months the contract continues month to month until either of us gives 30 days' notice.

Price changes. Colocation prices may rise by up to 3% on each anniversary of your contract. If the datacenter's cost of electricity rises, we may pass that increase on to you with at least 30 days' written notice.

Ending early. If you cancel a rack before the 12 months end, other than because we materially broke these Terms, you pay 50% of the monthly charges left in the contract, due within 30 days of cancelling.

11When a Colocation Service Ends

When a colocation Service ends, for any reason including unpaid invoices, we hold your equipment for 15 days from the end date. During that time you can arrange, by appointment, to collect it (rack-unit customers collect it from our staff), after paying any balance owed. After 15 days the equipment is considered abandoned, and we may remove, store at your cost, sell or dispose of it as the law allows, without further liability to you. We will send a written notice to the email address on your account when the 15 days begin.

12Governing Language

This policy is written in English, and the English version is the only legally binding version. Translations into other languages, including Simplified Chinese, Spanish and French, are provided for convenience only and are not legally binding. If a translation differs from the English version, or is unclear, the English version prevails.

13Changes to This Terms

We reserve the right to change this terms at any time. The version published on this page is the one in force. When we make a material change we will try to tell you by email or in the client area before it takes effect, and your continued use of our services afterwards means you accept the revised version.
